www.artsyrazvan.com respects the right to personal data protection of each person and has adopted measures to comply with the legal provisions of EU Regulation 679/2016 (“GDPR“), as well as other regulations in force in the field of personal data protection.

Among the compliance measures adopted is this Privacy Policy, a document that presents the practice of SMART PIXEL GRAPHICS SRL regarding the processing of personal data. SMART PIXEL GRAPHICS SRL is the entity that determines the means and purposes of processing personal data and, therefore, is the data controller (within the meaning of EU Regulation 679/2016).

The personal data controller is represented by:

  • SMART PIXEL GRAPHICS SRL, a limited liability company, headquartered in Bucharest, Romania, Sector 2, Baia de Aramă Street no. 1, bl. A, sc. 1, et. 1, ap. 7, hereinafter referred to as “Artsy Razvan”.

  • “Personal data” means any information relating to an identified or identifiable natural person;

  • “Controller” means the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data;
  • “Data subject” means an identified or identifiable natural person, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity;

2. What information do we collect from you and how?

Artsy Razvan collects information from you, as a user, in the following ways:

  • directly;
  • from traffic reports recorded by the servers hosting the site;
  • through cookies.

A. Information provided directly by the user

If you are a customer of our site, we will process your personal data, such as name and surname, phone number, email address, billing address, delivery address, data relating to how you use the Site, for example your behavior/preferences/habits within the company, as well as any other categories of data that you provide directly in the context of creating a user account, in the context of placing an order through the site or in any other way resulting from the use of the Site.

If you choose to create a user account only before completing an order for a product available on the site, your email address will be requested based on which an account will be automatically created. If you do not complete the order, the email address and other data provided will not be stored by our site, and the created account will be automatically deleted.

If you are a visitor to our Site, we will process your personal data that you provide directly in the context of using the site, such as the data you provide in the contact/questions/complaints section, to the extent that you contact us in this way.

Artsy Razvan uses your email address also to send you notifications about our products that might interest you or might be useful to you. The sending of emails for these purposes is done only after obtaining your consent for this purpose.

B. Information from the server traffic report

When you visit a website, you disclose certain information about yourself, such as your IP address, the time of your visit, the place from where you accessed our site.

3. When and how is the collected information used?

The purposes for which Artsy Razvan processes your personal data are:

  • establishing a collaboration (in order to provide our services);
  • to offer you a personalized experience on the site and the most efficient navigation;
  • fulfilling our legal obligations;
  • improving site functions;
  • ensuring, monitoring and evaluating compliance with our policies and standards, in order to identify persons authorized to transact on behalf of our customers, beneficiaries, suppliers and/or service providers;

The processing of your personal data, for the aforementioned purposes, is carried out by Artsy Razvan, legally, on the basis of the following grounds, provided by art. 6 para. (1) of EU Regulation 679/2016 (“Lawfulness of processing):

  1. In the performance of a contract to which you are a party (Art. 6 para. (1) lit. b) GDPR). This processing is carried out when, following your decision to contract our services, a contract has been concluded, and Artsy by Razvan processes your data, either on the occasion of concluding the contract, or in its execution.
  2. Based on your prior and express consent (Art. 6 para. (1) lit. a) GDPR).

Also, Artsy Razvan may process your personal data when:

  1. It is necessary for compliance with a legal obligation to which the controller is subject;
  2. It is necessary in order to protect your vital interests or those of another natural person;
  3. It is necessary for the performance of a task carried out in the public interest;
  4. It is necessary for the purposes of the legitimate interests pursued by Artsy Razvan or by a third party, except where such interests are overridden by your interests or fundamental rights and freedoms.

4. How do we protect the information?

Artsy Razvan respects your right to personal data protection, making all necessary efforts and taking all reasonable technical and administrative measures to ensure the confidentiality of your personal data.

The confidentiality and protection of information collected from you are our priorities.

Artsy Razvan does not disclose the information collected to third parties without your express and prior consent (except in the situations indicated in point 5- Who has access to the information collected from you?) or when the law obliges us to do so. Any statistics regarding our users’ traffic that we will offer to third-party advertising networks or to partner sites are provided only as aggregate data and do not include any personally identifiable information about any individual user.

Establishing a connection between you and the Artsy Razvan team, in order to access our services is conditioned by inserting the email address and sending a message. In the content of this message, you may disclose personal data, such as your phone number or your name and surname, a description of the situation for which you request Artsy Razvan services, as well as other data that you voluntarily disclose.

We recommend and ask you to limit yourself to the email address from which you send the message and at most to your name, which you insert in the message in order to establish a meeting with our consultants, following that the rest of the personal data necessary for the execution of our services will be disclosed later, on the occasion of concluding the service contract.

Unfortunately, no data provision over the internet can be guaranteed to be 100% secure. Consequently, despite our efforts to protect your personal information, Artsy by Razvan cannot ensure or guarantee the security of information transmitted by you to us, to and from our online services or our products.

However, when we receive the information transmitted by you, we guarantee that we will make every effort to ensure its security in our systems, according to the security standards imposed by the applicable legislation in force.

In this regard, we have implemented appropriate technical and organizational measures to maintain the confidentiality and security of your personal data, in accordance with internal procedures regarding the storage, transmission and accessing of personal data. Personal data may be kept on our technological systems or in printed format.

Regarding IT security, data processing operations, including their storage, are carried out through systems that ensure processing security, and operations are performed by competent persons, who have been informed and instructed regarding the confidentiality obligations of the data they come into contact with.

5. Who has access to the information collected from you?

Your personal data are processed for the purposes indicated in point 3- When and how is the collected information used?. This processing is carried out by Artsy Razvan. Processing is carried out by the company directly or through authorized persons, if applicable. Therefore, other natural or legal persons, except for these and some exceptional situations indicated below, will not have access to your personal data.

Artsy Razvan makes every effort and has adopted the necessary measures to ensure that third parties do not have access to your data, except in the case of an exceptional situation. Thus, there are situations where access to your data is imposed by legal provisions or the fulfillment of the company’s object of activity, or the good functioning/maintenance of the site.

Therefore, in certain circumstances, it is possible to disclose your personal data to:

  • persons who, based on a contract, ensure the maintenance of the site;
  • external consultants (for example, auditors or lawyers);
  • public authorities or institutions;
  • other natural or legal persons who contribute to or ensure the fulfillment of Artsy Razvan’s object of activity (logistics and courier service providers, etc);

6. Transfer of data outside the EU or EEA

Artsy Razvan does not disclose or transfer personal data it collects from you to third countries outside the European Union or the European Economic Area.

7. Retention period of collected information

The personal data provided by you will be processed as follows:

  • during our contractual relationship;
  • during the newsletter subscription period;
  • in case the legal provisions oblige us to keep the data for a certain period of time, for the duration of this period (eg. Accounting documents are kept according to the accounting law for a period of 10 years).

If your personal data are no longer necessary to comply with our contractual obligations or legal provisions, these data will be deleted periodically.

8. Your rights as data subjects

In accordance with art. 15 of EU Regulation 679/2016 (GDPR) you have, as a data subject, the following rights:

  1. Right of access to data – in accordance with this right, you can obtain from us a confirmation of the processing of personal data concerning you, as well as access to this data. Also, you can obtain, free of charge, a copy of the personal data provided to us and which are subject to processing. For any other copies requested by you, we have the right to charge a reasonable fee, based on administrative costs. If you submit the request in electronic format and unless you request another format, the information will be provided to you in a commonly used electronic format;
  2. Right to rectification – according to this right, you can obtain the rectification of your inaccurate personal data, as well as the right to obtain the completion of incomplete personal data;

III. Right to erasure of data – you have the right to obtain the erasure of personal data concerning you, without undue delay, and we have the obligation to erase the respective data, when:

  1. personal data are no longer necessary in relation to the purposes for which they were collected or processed; b. you withdraw the consent on which the processing is based and there is no other legal ground for processing; c. you object to the processing and there are no legitimate grounds which override regarding the processing; d. the personal data have been unlawfully processed; e. the personal data must be erased for compliance with a legal obligation incumbent on us under European Union law or Romanian legislation.
  2. Right to restriction of processing – according to this right, provided by art.18 of GDPR, you have the right to obtain from us restriction of processing of your data;
  3. Right to data portability – according to this right, you can receive your personal data, as they have been provided to us, in a structured, commonly used and machine-readable format and to transmit this data to another controller, under certain conditions;
  4. Right to object – you have the right to object, on grounds relating to your particular situation, at any time, to processing of your personal data, including profiling based on those provisions;

VII. Rights regarding profiling and decisions based solely on automated processing, including profiling- under this right, you can oppose profiling, as well as decisions based solely on automated processing;

VIII. Right to lodge a complaint based on art. 77 GDPR, addressed to the National Supervisory Authority for Personal Data Processing (ANSPDCP);

  1. Right to withdraw consent at any time, without affecting the lawfulness of processing of personal data carried out by us on the basis of consent before its withdrawal.
